Why Negotiations Restarted After the Inspection …

Recently, I wrote a blog post titled “Updated Homes Also Fail Inspections.” The purpose was to help sellers understand that even well-maintained and updated homes can have issues uncovered during a buyer’s inspection.

This transaction became another reminder of that reality. 

The home had been updated and lovingly maintained. It attracted a buyer and went under contract. Everything appeared to be moving forward smoothly.

Then came the inspection.

When Negotiations Restarted

What followed was a lengthy repair request involving termites, HVAC concerns, plumbing issues, appliances, and several other items. Suddenly, negotiations that many sellers assume are complete after a contract is signed had restarted.

This is something I’ve seen repeatedly throughout my real estate career.

Many sellers believe that once a buyer agrees to a price and signs a contract, the difficult part is over.

Often, the inspection period is where the real challenges begin.

As new information is uncovered, buyers may request repairs, credits, or concessions. Sellers are then faced with decisions they never expected to make when they accepted the offer.

The closer a transaction gets to closing, the more expensive uncertainty becomes.

By this point, the seller may have already packed, scheduled movers, transferred utilities, arranged for a new residence, or made plans for the next chapter of life.

Faced with the possibility of losing the buyer and putting the home back on the market, many sellers choose to offer credits or concessions to keep the transaction moving forward.

In many cases, those decisions are made under pressure and with limited time to evaluate alternatives.

The home looks flawless.

That’s exactly why many sellers are surprised when inspection issues surface.

One of the biggest misconceptions I see is the belief that cosmetic updates automatically mean a home is sound, insurable, and ready for the market.

Unfortunately, that’s not always the case.

A New Roof, No Guarantee to Pass Inspection

A few years ago, I sold a beautiful executive home. The property was exceptionally well maintained, and the roof was only two years old.

Everyone assumed the roof would pass inspection.

It didn’t.

Fortunately, the seller had valuable information about the home’s condition before a buyer became involved. Because the roof was still under warranty, we were able to pursue repairs through the builder.

Even then, it was challenging to get the issue corrected.

Had the problem surfaced during the buyer’s inspection period, the transaction would have been far more stressful. The seller would have been negotiating repairs under pressure with a contract hanging in the balance.

That experience reinforced an important lesson:

Newer doesn’t always mean problem-free.

Condos Aren’t Immune Either

More recently, I worked with a seller who owned a beautiful patio home structured as a condominium.

Like many condo owners, she assumed there would be very few property-related concerns because the association maintained many of the exterior components.

The home showed beautifully. It had been well cared for and looked ready for the market.

Before listing, I encouraged the seller to take additional steps to verify the property’s condition.

She was confident there would be no issues.

Later, termite activity was discovered within the building.

The lesson wasn’t about termites.

The lesson was about assumptions.

Many people believe condos are automatically less risky than single-family homes. While condos often reduce maintenance responsibilities, they don’t eliminate the possibility of property conditions, insurance concerns, association issues, or inspection-related discoveries.

Whether a property is a single-family home, townhome, patio home, or condominium, preparation still matters.

Buyers Don’t Purchase Assumptions

Today’s buyers are more informed than ever.

Choose the best flip-flops with arch support

The foot doc’ claim, “Yes, you can rock flip-flops (cute ones, too!) without your feet having to pay the price. However, there are sandal features that you should keep in mind to make that possible. For one, your flip-flops should never be paper-thin (unless you’re wearing them exclusively as shower shoes at the gym). In other words, if the flip-flops can easily break, they can easily damage your feet. Following are some tips the podiatrists say to keep in mind while shopping:

Foot Arch

Flip-flops feel different for each person, mainly due to your foot arch. Think of it this way: If you have a high arch, you need flip-flops with a similar high arch. If you have a flat arch, you need flip-flops with a lower arch.

Foot Shape

The footbed shape should follow your natural foot shape, Andersen says. Contoured footbeds are ideal because the molding tends to fit feet better. This type of footbed is often made of cork or natural latex and provides even distribution of your weight across the shoe. A contoured footbed is also more comfortable, because they consistently support your foot alignment while also helping to prevent painful injuries like shin splints and collapsed arches.

“A deep heel cup will increase the stability among other things,” Sayed explains. “Additionally, look for a midsole that is thick to assist with shock absorption.”

What Information Must Be Disclosed?

The Flood Disclosure form requires sellers to provide the following critical information:

Flood History: Sellers must disclose any previous flooding incidents on the property. This includes both minor and significant flooding events, regardless of whether they resulted in damage

Understanding the flood history of a property is essential for buyers, as it can indicate the likelihood of future flooding and potential repair costs.

Flood Insurance Claims: Sellers must state whether they have filed any flood insurance claims related to the property. This includes claims with private insurance providers as well as the National Flood Insurance Program (NFIP). Buyers need to know if the property has a history of flood insurance claims, as this could impact their ability to obtain insurance or result in higher premiums.

Federal Assistance for Flood Damage: Sellers must disclose if they have received any federal assistance for flood damage to the property. This includes aid from agencies such as the Federal Emergency Management Agency (FEMA). This information is crucial for buyers who want to understand the extent of past flood damage and any government involvement in repairs.

Flood Insurance Disclaimer: The form must include a disclaimer that clearly states: “Flood Insurance: Homeowners’ insurance policies do not include coverage for damage resulting from floods. Buyer is encouraged to discuss the need to purchase separate flood insurance coverage with Buyer’s insurance agent.” This disclaimer highlights the importance of flood insurance, which is often overlooked by buyers, especially in areas not typically associated with flooding.

Defining Flooding Under the New Law

For the purposes of the disclosure, the law defines flooding as a general or temporary condition of partial or complete inundation of the property caused by any of the following:

Overflow of Inland or Tidal Waters: This includes flooding caused by rising rivers, lakes, or coastal waters that overflow onto the land.

Rapid Accumulation of Surface Waters: This refers to flooding from heavy rainfall or other sources that cause water to accumulate quickly on the property.

Sustained Periods of Standing Water: This includes flooding caused by prolonged rainfall or other factors that result in standing water on the property for extended periods.

These definitions ensure that sellers disclose a wide range of flood-related risks, providing buyers with a comprehensive understanding of potential hazards.

Protecting Your Investment

For most people, buying a home is the most significant financial investment they will ever make. Purchasing a property without fully understanding its flood risk could lead to devastating financial losses if flooding occurs. The new Flood Disclosure law empowers buyers by providing them with the information they need to assess the risks associated with a property before committing to a purchase.

Flooding Risks Beyond Coastal Areas

While many people associate flooding with coastal regions, inland areas of Florida are also at risk. Urbanization, changes in land use, and the state’s flat topography can contribute to flooding even in areas far from the coast. This law ensures that buyers are informed about flood risks regardless of the property’s location, allowing them to make more educated decisions.

Implications for Sellers

For home sellers, the new law introduces additional responsibilities and potential challenges. It is essential for sellers to be aware of the information they are required to disclose and to ensure that the Flood Disclosure form is completed accurately and honestly. Failure to comply with the new requirements could lead to legal repercussions, including the possibility of lawsuits from buyers who suffer flood-related losses after purchasing the property.

Preparing Your Property for Sale

Sellers should take the time to gather all necessary information about their property’s flood history, insurance claims, and any federal assistance received. Working with a knowledgeable real estate agent can help sellers navigate these new requirements and ensure that they meet their obligations under the law.

Impact on Property Value

The requirement to disclose flood information may impact the perceived value of a property, particularly if it has a history of flooding. However, transparency is crucial in the real estate market, and providing potential buyers with complete and accurate information can help build trust and facilitate a smoother transaction.

Graham’s view on HOUSING PRICES: The good news – for buyers – is that prices are starting to get cut. A recent report found that “The share of available listings that saw a price cut in July rose to 18.9%, causing the median price to fall from $445,000 to $439,000.” Realtor dot com says there are two reasons for this: First, interest rates remain higher than expected (which means less buyer activity) and, two, a lot of would-be buyers are holding out for lower mortgage rates in the future – so, sellers are reducing their prices to entice them back.
